Allgemeine Geschäftsbedingungen von SGRO für DJ- und Veranstaltungsleistungen · Stand: August 2026
1. Geltungsbereich
1.1 Diese Allgemeinen Geschäftsbedingungen (nachfolgend „AGB“) gelten für alle Verträge, Leistungen und Angebote von SGRO, Inhaber Pasquale Sgro, Winkelhausenstr. 13a, 49090 Osnabrück (nachfolgend „SGRO“), im Bereich der DJ- und Veranstaltungsleistungen.
1.2 Entgegenstehende oder abweichende Bedingungen des Auftraggebers werden nicht anerkannt, es sei denn, SGRO stimmt ihrer Geltung ausdrücklich in Textform zu.
2. Vertragsparteien und Begriffe
2.1 Auftragnehmer im Sinne dieser AGB ist SGRO als Erbringer der DJ-Leistungen.
2.2 Auftraggeber ist der Kunde (Verbraucher oder Unternehmer), der die Leistungen von SGRO bucht.
2.3 Textform im Sinne dieser AGB umfasst insbesondere E-Mail.
3. Vertragsschluss
3.1 Angebote von SGRO sind freibleibend und unverbindlich. Sie haben, sofern nicht anders angegeben, eine Gültigkeitsdauer von einem Monat ab Angebotsdatum.
3.2 Der Vertrag kommt zustande, wenn der Auftraggeber das Angebot in Textform annimmt und SGRO die Buchung in Textform bestätigt (Buchungsbestätigung).
4. Leistungsumfang
4.1 SGRO erbringt die im Angebot bzw. in der Buchungsbestätigung vereinbarten DJ-Leistungen einschließlich der dort aufgeführten Ton- und Lichttechnik.
4.2 Die musikalische Gestaltung erfolgt – unter Berücksichtigung abgestimmter Wünsche des Auftraggebers – im künstlerischen Ermessen von SGRO.
4.3 Änderungen oder Erweiterungen des Leistungsumfangs bedürfen einer Vereinbarung in Textform.
5. Vergütung und Zahlungsbedingungen
5.1 Die Vergütung ergibt sich aus dem Angebot bzw. der Buchungsbestätigung. Alle Preise verstehen sich, sofern nicht anders angegeben, inklusive der gesetzlichen Umsatzsteuer.
5.2 Zur Bestätigung der Buchung ist eine Anzahlung von 50 % des Gesamtbetrags innerhalb von 7 Tagen nach Erhalt der Buchungsbestätigung zu zahlen.
5.3 Der Restbetrag ist spätestens 14 Tage vor dem Veranstaltungstermin zu zahlen.
5.4 Über die vereinbarte Spielzeit hinausgehende Verlängerungsstunden werden zu dem im Angebot genannten Stundensatz berechnet; jede angefangene Stunde wird als volle Stunde abgerechnet. Die Vergütung für Verlängerungsstunden ist innerhalb von 14 Tagen nach Rechnungsstellung fällig.
6. Mitwirkungspflichten des Auftraggebers
6.1 Der Auftraggeber stellt sicher, dass SGRO rechtzeitig – in der Regel mindestens zwei Stunden vor Veranstaltungsbeginn – Zugang zum Veranstaltungsort für Aufbau und Soundcheck erhält. Entsprechendes gilt für den Abbau nach Veranstaltungsende.
6.2 Der Auftraggeber stellt unentgeltlich zur Verfügung: (a) mindestens einen separat abgesicherten 230-V-Stromanschluss (16 A) in unmittelbarer Nähe der Aufbaufläche, (b) eine ebene, trockene und tragfähige Stellfläche von ca. 3 x 2 m, (c) eine Park- und Entlademöglichkeit in unmittelbarer Nähe des Veranstaltungsortes.
6.3 Bei Veranstaltungen im Freien ist ein überdachter, wind- und regengeschützter Aufbauort mit ebenem Untergrund bereitzustellen. SGRO ist berechtigt, die Leistung zu unterbrechen oder einzustellen, wenn Witterungseinflüsse die Technik oder Personen gefährden; der Vergütungsanspruch bleibt in diesem Fall bestehen.
6.4 Der Auftraggeber sorgt für die Sicherheit des Veranstaltungsortes und trifft zumutbare Vorkehrungen, damit die Technik vor unbefugtem Zugriff, insbesondere durch Gäste, geschützt ist.
6.5 Der Auftraggeber holt erforderliche behördliche Genehmigungen ein und stellt die Einhaltung geltender Auflagen (z. B. Lärmschutz, Sperrzeiten) sicher.
6.6 Bei Einsätzen von mehr als vier Stunden stellt der Auftraggeber SGRO unentgeltlich alkoholfreie Getränke und nach Möglichkeit eine Mahlzeit zur Verfügung.
6.7 Stellt der Auftraggeber die Veranstaltungstechnik ganz oder teilweise selbst und wurde ihm ein Techrider von SGRO übergeben, stellt der Auftraggeber die dort aufgeführten technischen Anforderungen auf eigene Kosten sicher. Der Techrider ist in diesem Fall Bestandteil des Vertrags.
6.8 Der Auftraggeber sorgt für einen für die Veranstaltung üblichen bzw. behördlich vorgeschriebenen Versicherungsschutz (z. B. Veranstalterhaftpflicht), der Schäden und Verletzungen im Zusammenhang mit der Veranstaltung abdeckt.
7. Reisekosten und Unterkunft
7.1 Sofern im Angebot bzw. in der Buchungsbestätigung nichts anderes geregelt ist, sind An- und Abreise im näheren Umkreis von Osnabrück in der Vergütung enthalten. Bei Veranstaltungen außerhalb dieses Umkreises trägt der Auftraggeber die angemessenen Reisekosten von SGRO (Pkw, Bahn oder – nach vorheriger Absprache – Flug) gemäß Angebot bzw. gesonderter Vereinbarung in Textform.
7.2 Ist aufgrund der Entfernung oder der Endzeit der Veranstaltung eine Übernachtung erforderlich, stellt der Auftraggeber auf eigene Kosten eine Unterkunft in einem Hotel mit mindestens 3 Sternen (Doppelzimmer, nach Möglichkeit mit Late-Check-out) einschließlich Verpflegung zur Verfügung oder erstattet die entsprechenden Kosten. Die Einzelheiten werden vorab in Textform abgestimmt.
8. GEMA
8.1 Die Anmeldung der Veranstaltung bei der GEMA sowie die Zahlung anfallender GEMA-Gebühren obliegen dem Auftraggeber, sofern nicht ausdrücklich etwas anderes vereinbart ist.
8.2 Bei privaten Veranstaltungen im geschlossenen Kreis (z. B. Hochzeiten oder Geburtstagsfeiern mit ausschließlich persönlich geladenen Gästen) handelt es sich in der Regel nicht um eine öffentliche Wiedergabe im Sinne des Urheberrechts; eine GEMA-Anmeldung ist dann nicht erforderlich und es fallen keine GEMA-Gebühren an.
9. Stornierung durch den Auftraggeber
9.1 Eine Stornierung ist SGRO in Textform (E-Mail) oder per Post mitzuteilen. Maßgeblich ist der Zugang der Erklärung bei SGRO.
9.2 Im Fall der Stornierung kann SGRO eine pauschale Entschädigung in Höhe des folgenden Anteils der vereinbarten Gesamtvergütung (brutto) verlangen:
- bis 6 Monate vor dem Veranstaltungstermin: 20 %
- weniger als 6 Monate bis 3 Monate vor dem Termin: 40 %
- weniger als 3 Monate bis 1 Monat vor dem Termin: 60 %
- weniger als 1 Monat bis 15 Tage vor dem Termin: 80 %
- 14 Tage oder weniger vor dem Termin sowie bei Nichtinanspruchnahme der Leistung: 90 %
9.3 Dem Auftraggeber bleibt der Nachweis unbenommen, dass SGRO kein oder ein wesentlich geringerer Schaden entstanden ist. SGRO muss sich ersparte Aufwendungen sowie einen durch anderweitige Verwendung des Termins erzielten Erwerb anrechnen lassen.
9.4 Bereits geleistete Zahlungen werden auf die Entschädigung angerechnet; ein überschießender Betrag wird erstattet.
10. Absage durch SGRO
10.1 SGRO ist berechtigt, vom Vertrag zurückzutreten, wenn die Veranstaltung aus Gründen höherer Gewalt (z. B. Unwetter, Naturkatastrophen, behördliche Anordnungen) nicht durchgeführt werden kann. In diesem Fall werden bereits gezahlte Beträge vollständig erstattet; weitergehende Ansprüche bestehen – soweit gesetzlich zulässig – nicht.
10.2 Kann SGRO die Leistung aus anderen Gründen (z. B. plötzliche Erkrankung, technischer Ausfall) nicht erbringen, wird SGRO sich nach besten Kräften bemühen, einen gleichwertigen Ersatz-DJ zu vermitteln. Gelingt dies nicht, bietet SGRO dem Auftraggeber einen Ersatztermin an oder erstattet sämtliche bereits gezahlten Beträge vollständig. Ziffer 12 (Haftung) bleibt unberührt.
11. Änderungen von Buchungen
11.1 Änderungswünsche (z. B. Termin, Ort, Umfang) sind SGRO in Textform mitzuteilen.
11.2 SGRO wird sich bemühen, Änderungen zu ermöglichen, kann diese jedoch ablehnen, wenn sie zu erheblichem Mehraufwand führen oder der gewünschte neue Termin bereits belegt ist. Eine Terminverschiebung, der SGRO zustimmt, gilt nicht als Stornierung. Kommt keine Einigung über einen neuen Termin zustande, gilt Ziffer 9 entsprechend.
12. Haftung
12.1 SGRO haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie – auch bei einfacher Fahrlässigkeit – für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit.
12.2 Bei einfach fahrlässiger Verletzung wesentlicher Vertragspflichten (Kardinalpflichten), also solcher Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung der Auftraggeber regelmäßig vertrauen darf, ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt.
12.3 Im Übrigen ist die Haftung von SGRO ausgeschlossen. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.
13. Schäden an der Technik
Der Auftraggeber haftet für Schäden an der von SGRO eingesetzten Ton-, Licht- und sonstigen Technik, die durch ihn, seine Gäste oder von ihm beauftragte Dritte schuldhaft verursacht werden. Dem Auftraggeber bleibt der Nachweis fehlenden Verschuldens unbenommen.
14. Zahlungsverzug
14.1 Bei Zahlungsverzug des Auftraggebers ist SGRO berechtigt, Verzugszinsen in gesetzlicher Höhe zu verlangen: gegenüber Verbrauchern 5 Prozentpunkte, gegenüber Unternehmern 9 Prozentpunkte über dem Basiszinssatz p. a.
14.2 Der Verzug tritt nach Maßgabe der gesetzlichen Vorschriften ein, spätestens 30 Tage nach Fälligkeit und Zugang der Rechnung oder einer gleichwertigen Zahlungsaufforderung.
14.3 Befindet sich der Auftraggeber mit der Anzahlung oder der Restzahlung in Verzug, ist SGRO nach erfolglosem Ablauf einer angemessenen Nachfrist berechtigt, vom Vertrag zurückzutreten und eine Entschädigung entsprechend Ziffer 9.2 zu verlangen.
15. Widerrufsrecht
Wird der Vertrag mit einem Verbraucher im Fernabsatz oder außerhalb von Geschäftsräumen geschlossen, besteht gemäß § 312g Abs. 2 Nr. 9 BGB kein Widerrufsrecht, da die Dienstleistung im Zusammenhang mit Freizeitbetätigungen erbracht wird und der Vertrag einen spezifischen Termin für die Erbringung vorsieht.
16. Bild- und Tonaufnahmen
SGRO ist berechtigt, während der Veranstaltung Bild- und Tonaufnahmen des eigenen Auftritts zu Zwecken der Eigenwerbung (z. B. Website, Social Media) anzufertigen und zu verwenden, sofern der Auftraggeber dem nicht in Textform widerspricht. Persönlichkeitsrechte von Gästen werden beachtet; auf Wunsch werden Aufnahmen, auf denen Personen erkennbar sind, nicht veröffentlicht oder entfernt.
17. Verbraucherstreitbeilegung
SGRO ist nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle im Sinne des Verbraucherstreitbeilegungsgesetzes (VSBG) teilzunehmen.
18. Salvatorische Klausel
Sollten einzelne Bestimmungen dieser AGB ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. An die Stelle der unwirksamen Bestimmung treten die gesetzlichen Regelungen.
19. Schlussbestimmungen
19.1 Es gilt das Recht der Bundesrepublik Deutschland.
19.2 Ist der Auftraggeber Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen oder hat er keinen allgemeinen Gerichtsstand in Deutschland, ist ausschließlicher Gerichtsstand der Sitz von SGRO.
19.3 Diese AGB sind Bestandteil jedes Vertrags mit SGRO.

General Terms and Conditions of SGRO for DJ and event services · Version: August 2026 – Convenience translation; in case of discrepancies, the German version prevails.
1. Scope of Application
1.1 These General Terms and Conditions (hereinafter “GTC”) apply to all contracts, services and offers of SGRO, owner Pasquale Sgro, Winkelhausenstr. 13a, 49090 Osnabrück, Germany (hereinafter “SGRO”), in the field of DJ and event services.
1.2 Conflicting or deviating terms and conditions of the Client are not recognised unless SGRO expressly agrees to their validity in text form.
2. Contracting Parties and Definitions
2.1 The Contractor within the meaning of these GTC is SGRO as the provider of the DJ services.
2.2 The Client is the customer (consumer or entrepreneur) who books the services of SGRO.
2.3 Text form within the meaning of these GTC includes, in particular, email.
3. Conclusion of Contract
3.1 Offers from SGRO are subject to change and non-binding. Unless otherwise stated, they are valid for one month from the date of the offer.
3.2 The contract is concluded when the Client accepts the offer in text form and SGRO confirms the booking in text form (booking confirmation).
4. Scope of Services
4.1 SGRO provides the DJ services agreed in the offer or booking confirmation, including the sound and lighting equipment listed therein.
4.2 The musical programme is at the artistic discretion of SGRO, taking into account requests agreed with the Client.
4.3 Changes or extensions to the scope of services require an agreement in text form.
5. Remuneration and Terms of Payment
5.1 The remuneration is set out in the offer or booking confirmation. Unless otherwise stated, all prices include statutory VAT.
5.2 To confirm the booking, a deposit of 50% of the total amount is payable within 7 days of receipt of the booking confirmation.
5.3 The remaining amount is payable no later than 14 days before the date of the event.
5.4 Extension hours beyond the agreed performance time are charged at the hourly rate stated in the offer; each commenced hour is charged as a full hour. Remuneration for extension hours is due within 14 days of invoicing.
6. Duties of the Client to Cooperate
6.1 The Client shall ensure that SGRO has timely access to the venue for set-up and sound check, as a rule at least two hours before the start of the event. The same applies to dismantling after the end of the event.
6.2 The Client shall provide free of charge: (a) at least one separately fused 230 V power connection (16 A) in the immediate vicinity of the set-up area, (b) a level, dry and load-bearing set-up area of approx. 3 x 2 m, (c) parking and unloading facilities in the immediate vicinity of the venue.
6.3 For outdoor events, a covered set-up location protected from wind and rain with level ground must be provided. SGRO is entitled to interrupt or discontinue the performance if weather conditions endanger the equipment or persons; the claim to remuneration remains unaffected in this case.
6.4 The Client shall ensure the safety of the venue and take reasonable precautions to protect the equipment from unauthorised access, in particular by guests.
6.5 The Client shall obtain any necessary official permits and ensure compliance with applicable requirements (e.g. noise protection, curfew regulations).
6.6 For engagements of more than four hours, the Client shall provide SGRO with non-alcoholic beverages free of charge and, where possible, a meal.
6.7 If the Client provides the event technology in whole or in part and has received a technical rider from SGRO, the Client shall ensure, at its own expense, that the technical requirements set out therein are met. In this case, the technical rider forms an integral part of the contract.
6.8 The Client shall ensure insurance coverage customary or officially required for the event (e.g. event liability insurance) covering damage and injuries in connection with the event.
7. Travel Expenses and Accommodation
7.1 Unless otherwise agreed in the offer or booking confirmation, travel to and from events in the wider Osnabrück area is included in the remuneration. For events outside this area, the Client shall bear SGRO’s reasonable travel expenses (car, train or – by prior arrangement – flight) in accordance with the offer or a separate agreement in text form.
7.2 If an overnight stay is required due to the distance or the end time of the event, the Client shall provide, at its own expense, accommodation in a hotel with at least 3 stars (double room, with late check-out where possible) including meals, or reimburse the corresponding costs. The details will be agreed in advance in text form.
8. GEMA
8.1 Registration of the event with GEMA (the German collecting society) and payment of any GEMA fees are the responsibility of the Client, unless expressly agreed otherwise.
8.2 Private events held within a closed circle (e.g. weddings or birthday parties with exclusively personally invited guests) do not, as a rule, constitute a public performance within the meaning of copyright law; in that case, no GEMA registration is required and no GEMA fees are incurred.
9. Cancellation by the Client
9.1 A cancellation must be communicated to SGRO in text form (email) or by post. The time of receipt of the declaration by SGRO is decisive.
9.2 In the event of cancellation, SGRO may demand lump-sum compensation amounting to the following share of the agreed total remuneration (gross):
- up to 6 months before the date of the event: 20%
- less than 6 months to 3 months before the date: 40%
- less than 3 months to 1 month before the date: 60%
- less than 1 month to 15 days before the date: 80%
- 14 days or less before the date, and in the event of non-utilisation of the service: 90%
9.3 The Client remains free to prove that SGRO has suffered no loss or a substantially lower loss. SGRO must allow credit for expenses saved and for any income obtained through alternative use of the date.
9.4 Payments already made will be offset against the compensation; any excess amount will be refunded.
10. Cancellation by SGRO
10.1 SGRO is entitled to withdraw from the contract if the event cannot take place for reasons of force majeure (e.g. severe weather, natural disasters, official orders). In this case, amounts already paid will be refunded in full; further claims are excluded to the extent permitted by law.
10.2 If SGRO is unable to perform for other reasons (e.g. sudden illness, technical failure), SGRO will use its best efforts to arrange an equivalent replacement DJ. If this is not possible, SGRO will offer the Client an alternative date or refund all amounts already paid in full. Clause 12 (Liability) remains unaffected.
11. Changes to Bookings
11.1 Requests for changes (e.g. date, venue, scope) must be communicated to SGRO in text form.
11.2 SGRO will endeavour to accommodate changes but may refuse them if they result in significant additional effort or if the requested new date is already booked. A postponement to which SGRO agrees does not constitute a cancellation. If no agreement on a new date is reached, Clause 9 applies accordingly.
12. Liability
12.1 SGRO is liable without limitation for intent and gross negligence and – including in cases of simple negligence – for damages arising from injury to life, body or health.
12.2 In the event of a simply negligent breach of essential contractual obligations (cardinal obligations), i.e. obligations whose fulfilment is a prerequisite for the proper performance of the contract and on whose observance the Client may regularly rely, liability is limited to the foreseeable damage typical for the contract.
12.3 In all other respects, the liability of SGRO is excluded. Liability under the German Product Liability Act remains unaffected.
13. Damage to Equipment
The Client is liable for damage to the sound, lighting and other equipment used by SGRO that is culpably caused by the Client, the Client’s guests or third parties commissioned by the Client. The Client remains free to prove the absence of fault.
14. Default of Payment
14.1 If the Client is in default of payment, SGRO is entitled to demand default interest at the statutory rate: 5 percentage points above the base interest rate p.a. for consumers, and 9 percentage points above the base interest rate p.a. for entrepreneurs.
14.2 Default occurs in accordance with the statutory provisions, at the latest 30 days after the due date and receipt of the invoice or an equivalent request for payment.
14.3 If the Client is in default with the deposit or the final payment, SGRO is entitled, after the unsuccessful expiry of a reasonable grace period, to withdraw from the contract and to demand compensation in accordance with Clause 9.2.
15. Right of Withdrawal
If the contract is concluded with a consumer by means of distance communication or away from business premises, there is no right of withdrawal pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), as the service is provided in connection with leisure activities and the contract provides for a specific date for performance.
16. Photo and Sound Recordings
SGRO is entitled to make and use photo and sound recordings of its own performance during the event for its own advertising purposes (e.g. website, social media), unless the Client objects in text form. Personal rights of guests will be respected; upon request, recordings in which persons are identifiable will not be published or will be removed.
17. Consumer Dispute Resolution
SGRO is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG).
18. Severability Clause
Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
19. Final Provisions
19.1 The law of the Federal Republic of Germany applies.
19.2 If the Client is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction is the registered office of SGRO.
19.3 These GTC form an integral part of every contract with SGRO.
